If this waiver is found to be unenforceable, then the entirety of the arbitration provision shall be null and void.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the completion of arbitration proceedings. Such action shall not constitute a waiver of the right to arbitrate the underlying dispute.
